Apata Terms & Conditions

Welcome to Apata, a real estate marketplace owned and operated by QuickGix Technologies Ltd. These Terms & Conditions (“Terms”) govern your access and use of Apata’s mobile application, website (Apata.com.gh), and related services (collectively, the “Platform”).

By registering as a user, landlord, or agent, or by accessing or using the Platform, you agree to these Terms. Please read carefully. If you do not agree, you may not use Apata.


1. Definitions

  • “User” – Any renter, buyer, or individual browsing or searching properties.
  • “Landlord” – A property owner listing their property directly on Apata.
  • “Agent/Provider” – A licensed agent, broker, or representative listing properties on behalf of landlords.
  • “Listing” – A property submitted to the Platform for rent, sale, or short stay.
  • “We/Us/Our” – QuickGix Technologies Ltd. (Apata).

2. Eligibility

  • You must be 18 years or older to use Apata.
  • You must provide accurate and verifiable information when creating an account.
  • Agents must have proof of authorization from property owners before listing on Apata.

3. Account Registration & Verification

  • All landlords and agents must complete KYC verification, including:
  • Apata reserves the right to grant, revoke, or suspend “Verified” status at any time.

4. Listing Rules

All listings must:

  • Contain accurate, up-to-date information (price, size, location, amenities).
  • Include recent, authentic photos or videos (no stock or stolen images).
  • Reflect availability (no posting sold, rented, or fake properties).
  • Show the correct GPS pin/location.

Prohibited listings include:

  • Duplicate properties
  • Misleading or “bait” properties used to upsell alternatives
  • Properties without proper authorization

5. Viewing Fee Policy

To protect renters and buyers:

  • No advance viewing fees are allowed under any circumstances.
  • A viewing fee may only be charged after the property shown matches the listing.
  • Viewing fees must be reasonable and non-exploitative (Apata recommends not exceeding GHS 150).
  • All fees must be clearly disclosed in the listing description.
  • Agents or landlords demanding undisclosed, hidden, or advance fees will face suspension or removal.

6. Tenant Protection

Users are entitled to:

  • Transparent pricing with no hidden charges.
  • Verified property information when listings carry the “Apata Verified” badge.
  • Report listings, landlords, or agents who breach policies.
  • Resolution of disputes through Apata’s support within 48–72 hours.

7. Prohibited Practices (Zero Tolerance)

The following are strictly forbidden on Apata:

  • Bait-and-switch listings – advertising one property but showing another.
  • Charging fees outside the platform or undisclosed to the user.
  • Posting fake, stolen, or outdated photos.
  • Harassing or misleading users.
  • Conducting off-platform transactions that bypass Apata’s safeguards.

8. Subscriptions, Packages & Payments

  • Apata offers credit plans (Solo Landlord, Multi-Propert Landlord, Pro Agent, Premium Partner, Enterprise) and promotional boosts (featured listings, banner ads, project spotlights).
  • Payment must be made through Apata’s approved channels (e.g., mobile money, Paystack, bank).
  • All payments are non-refundable, unless otherwise required by law.
  • Listings will expire at the end of the subscription/package period unless renewed.

9. Dispute Resolution

  • Users may report disputes (e.g., false listings, misrepresentation, fees).
  • Apata will investigate within 48–72 hours.
  • Apata may suspend accounts, remove listings, or ban violators permanently.
  • Apata acts as a platform facilitator, not a party to tenancy or sales contracts.

10. Platform Security

  • All users must keep login details confidential.
  • Fraudulent activity, hacking attempts, or misuse of Apata’s system will result in immediate suspension and possible legal action.
  • Apata is not responsible for transactions conducted outside the Platform.

11. Limitation of Liability

  • Apata provides a platform to connect users, landlords, and agents.
  • We do not guarantee tenancy, sales, or the condition of properties.
  • Apata is not liable for losses, damages, or disputes arising from off-platform agreements.

12. Termination & Suspension

We may suspend or terminate accounts for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Multiple unresolved tenant complaints
  • Failure to verify ownership or authorization

13. Privacy Policy

Use of Apata is subject to our Privacy Policy, which explains how we collect, use, and protect your data.


14. Changes to Terms

We may update these Terms periodically. Users will be notified of material changes by email or in-app alert. Continued use of Apata means acceptance of the updated Terms.


15. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Disputes shall be resolved under Ghanaian legal jurisdiction.
